For Gated, Private Communities with Pools:
THIS IS GROSSY WRONG AND UNCONSTITUTIONAL

This whole matter boils down to Nevada's wrong definition of Public vs. Private pool facility. Nevada Revised Statutes lumps "Private Gated Communities" in with hotels and public pool facilities in their definition of "Public Pool." This is so wrong in so many ways that it makes one's head spin. This must be changed quickly. Fight your management company and your pool vendor when they try to force you to comply! No mater what your pool vendor or management company tells you, there are no million dollar fines for lack of compliance!!! Read the Enforcement Document Here!

Private gated communities are respnsible for the upkeep of our own roads, along with every other aspect of property management that might normally be subject to public county or city works. Our pools are in every way private.

Who are these thugs that they think they can come into our homes and force us to comply with a Federal act that clearly is inteneded to apply to PUBLIC pool facilities. That means facilities that are OPEN TO THE PUBLIC!!!

This will not stand and we must put an end to the raping of HOAs in Nevada.

Raping Helping HOAs from California to Nevada... and Beyond?

It has been reported to us (we were not invited) that the California law firm of Wolf, Rifkin, Shapiro, Schulman & Rabkin, LLP, recently hosted an informative meeting regarding 2007 "Virginia Graeme Baker Pool and Spa Safety Act," in partnership with the SNHD, Southern Nevada Health Distict.

The first question that came to my mind was, of course, why is an HOA law firm hosting an event for a government agency? I decided to call the law firm and ask. I was hung up on.

This boils down to homeowner property rights, federal usurpation of those rights and Nevada's purposely incorrect definition of the term "Public Pool." This new federal act, Virginia Graeme Baker Pool and Spa Safety Act, is directed toward "Public Pools" and Nevada's badly worded, bad-intended definition of "Public Pool" includes HOAs and condominiums.


Pool Phone Lines

Our money starved state of Nevada, along with partner Clark County, is beginning a new economic stimulus package guaranteed to generate income for specific segments of private, Homeowner Association related vendors and businesses. All sorts of new regulations are popping up for HOAs in Nevada.

First up: private gated communities, who are normally charged with the maintenance and upkeep of what would otherwise be public services, are suddenly being compelled to install telephone lines around their private pools.

HOAs all over Clark County are being compelled to install these phones lines under threat of pool facility closure. We are currently waiting for a response from the Clark County Health District on this issue.
